These Terms of Service (“Terms”/ “Terms of Service”/ “Terms of Use”) cover your use of and access to this site, offered services, products, applications, tools and features (collectively, the "Services") provided by Awake in Power’ (as defined below), on this website www.AwakeinPower.com, and of the associated domains: www.squarespace.com and www.acuityscheduling.com and www.stripe.com.
By using or accessing the Services, you're agreeing to these Terms, our Cookie Policy, and our Privacy Policy (collectively, this “Agreement”). If you're using the Services for an organization, you're agreeing to this Agreement on behalf of that organization, and you represent and warrant that you can do so. References to “you”, “your” and similar terms are construed accordingly in this Agreement.

ACKNOWLEDGEMENT And RELEASE for Programs, Events, Sessions, and Audio Tracks: By visiting this site, signing up for, purchasing or participating in a private session, a live or recorded program, call or event the purchaser/ participant states that they have read this acknowledgement and release, that they understand the terms contained in it and that they have freely and voluntarily executed the same and intend to be bounds by its terms. If you do not agree, you may not use this site, participate in any event or program, or use or purchase products or services from Awake in Power or its trustees.

The participant desires to attend a Awake in Power Service, Business or Home immersion, Event, Program, or Session (the “Event”), and in consideration of being admitted to and allowed to participate in the Event (“Participation”), the participant agrees, understands and acknowledges that:
The spiritual work of Awake in Power is not a physical or medical treatment and Participation should not be viewed as a substitute for proper medical, psychological or physical care provided by the participant’s physician or medical professional. Awake in Power and its trustees are not a licensed medical professional of any kind. Awake in Power does not handle medical or psychological emergencies and there is no diagnosis of illness or disease, nor psychological or drug treatment in any program. Awake in Power does not make any claims whatsoever, whether expressed or implied, regarding conditions, effects or outcomes of the analyses or services provided, and shall not be liable for the same. Participant recognizes and accepts all risks and limitations involved in seeking advice, coaching, consulting, mentoring, energy work, spiritual work or any other service, product, or business from Awake in Power.
All content, including text, graphics, images and information, contained on or available through this web site is for general information purposes only. Results shared are not guaranteed, you may or may not experience anything from sessions, programs, events, or audio tracks. Where specific examples are quoted from individuals there is no assurance you will do as well. In the event that you use the information for your own health, you are prescribing for yourself which is your constitutional right and for which Awake in Power assumes no responsibility.
Delivery & Refund Information
All Digital products, Live Events, Immersions, Programs, Sessions, and Services are non-refundable.
For MP3 downloads, you will receive a link for immediate download plus an email with download links. You must be logged in for the links to work. You can also find the download links under your account information. The download links will expire. You can download the mp3 files for 10 days only so be sure to download all of them and make back-up copies – we cannot resend mp3’s to you again later if you lose them, so please back up your files in a safe, permanent place.
Once files are downloaded all sales are final. We do not refund for products which have been downloaded. If you received an incompatible file, email us through the contact us page and we will send you an alternate file.
Live events and group programs have a specified start and end date and are non-refundable. This cannot be extended outside of the dates specified – meaning Awake in Power cannot make up missed days for a program or event or give partial refunds if you signed up late or didn’t fully participate for part of the program.
Sessions are not recorded.
All the following legal jargon required by law also applies to subscriptions and all other
products and services offered by Helena Witschge and Awake in Power.
* For Digital products (downloads/ recordings) you are purchasing a license agreement for a single individual’s use. Sharing digital downloads is Digital Theft, which is illegal and trackable. Please honor the energy exchange and do not share downloads/ recordings with others. If you think someone you know would benefit from them, invite them to purchase their own products.
How do you bill my credit card?
It will show up as Awake in Power.
Electronic Communications
When you visit the awakeinpower.com website or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We may send you marketing emails, which you can unsubscribe from by clicking the link at the bottom of the email. We share your contact information with Squarespace, our website hosting provider, so they can send these emails on our behalf. We will not lend or sell your email address to any other organization. When you send us an email (as distinguished from a secure order form, which is encrypted), it is not necessarily secure and is not encrypted. It is our policy to never send your credit card number via e-mail. While we implement the above and other security measures to protect your information, please note that no data transmitted over the Internet or any other public network can be guaranteed to be 100% secure.

No part of the Site and no content may be reproduced, recorded, retransmitted, sold, rented, broadcast, distributed, published, uploaded, posted, publicly displayed, altered to make new works, performed, digitized, compiled, translated or transmitted in any way to any other computer, website or other medium or for any commercial purpose, without Awake in Power prior express written consent. You are not granted any rights or license to patents, copyrights, trade secrets, trade dress, rights of publicity or trademarks with respect to any of the content, and Awake in Power reserves all rights not expressly granted hereunder.
Testimonials
Testimonials submitted may be added to the website unless otherwise requested. Any testimonials placed on the website will be totally anonymous unless allowed by the testimonial giver in writing.
License to Use Downloaded or Streamed Audio and Video
When you download or stream audio or video content (“Content”) made available by Awake in Power either for free or for a fee, Awake in Power, grants you a limited, revocable, non-exclusive, non-transferable license to download or stream such Content to your computer and/or your personal listening or viewing device(s) solely for your personal non-commercial use. You agree not to copy, reproduce, transmit, display, perform, publish, license, or distribute or use Content in any other manner. You shall not sell, transfer, lease, modify, create derivative work from, distribute or publicly perform the Content in any manner and you shall not exploit it commercially. You may inquire about obtaining written permission from us for a non-personal use by writing us at info@awakeinpower.com.
Security Policy; Your Account;
The safety of your credit card information is important to us, and we have taken measures to protect the security of your online order information.
We use Secure Sockets Layer (SSL) technology to provide both server authentication and data encryption. SSL technology encrypts your credit card number and other order information you input before it is sent to us. You can determine the security of your connection by looking at the bottom of your Internet browser window after you have accessed our website-SSL technology is active if there is a solid key or a closed lock. In addition, we do not store your credit card information on our servers.

Some portions of this website permit username and passwords to be used. Conditions of Sale & Payment Terms.
To purchase any goods and/or services on our Site, you must (a) be at least eighteen (18) years of age or the applicable state age of majority, and (b) be a natural person (no corporations, partnerships or other legal entities). Prior to the purchase of any goods or services on our Site, you must provide us with a valid credit card number and associated payment information including all of the following: (i) your name as it appears on the card, (ii) your credit card number, (iii) the credit card type, (iv) the date of expiration & (v) any activation numbers or codes needed to charge your card. By submitting that information to us, you hereby agree that you authorize us to charge your card at our convenience but within thirty (30) days of credit card authorization. All sales of mp3 download products and all services are final.
Methods of Payment, Credit Card Terms & Taxes.
All payments must be made by VISA, MasterCard or another online payment option provided through Stripe (each of which may be removed by Awake in Power in its sole discretion, and payment methods accepted for each product or service may vary). Unless expressly set forth on the Awake in Power website, we do not accept any other payment form. If we offer or accept any other form of payment, you hereby agree to all restrictions, terms & conditions associated with such additional form of payment. Your card issuer agreement governs your use of your designated card, & you must refer to that agreement and not this Terms of Service to determine your rights & liabilities as a cardholder. You agree to pay all fees & charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. Unless you notify Awake in Power of any discrepancies within sixty (60) days after they first appear on your credit card statement, you agree that they will be deemed accepted by you for all purposes. If Awake in Power does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by Awake in Power or its trustees. You are responsible for paying any governmental taxes imposed on your purchases, including, but not limited to, sales, use or value-added taxes. Awake in Power shall automatically charge & withhold the applicable sales tax that is legally required according to the Sales Tax Policies of the Netherlands.
Modifications to Prices or Billing Terms.
Awake in Power reserves the right, at any time, to change its prices & billing methods for products or services sold, effective immediately upon posting on the site.
Indemnification.
You agree to indemnify & hold harmless Awake in Power & its parents, sister companies, subsidiaries, affiliates, service providers, other End Users, distributors, licensors, officers, directors & employees from any claim or demand, including reasonable attorneys’ fees, made by any third party arising out of or related to your violation of this Terms of Use, or your violation of any law, regulation or third-party right.

REDEMPTION OF FREE PRODUCT AND COUPON OFFERS
From time to time Awake in Power offers its clients special offers and discount codes to be used in conjunction with this website. These offers are frequently disseminated via this website and through email to those who have registered for our email database. They are sometimes posted on our home page awakeinpower.com or announced via other means of communication in conjunction with the promotion of the Awake in Power, product collection, audio and video programs, articles, radio and TV broadcasts, internet forums and various online websites.
We encourage our clients to redeem these special offers, but we respectfully ask that you not exploit them.
Awake in Power, at our sole discretion, will determine if all purchasing criteria has been met to qualify for stated discount or free product. If you successfully circumvent the software safeguards of this website in order to receive several free products with your order, then we will (at our sole discretion) remove any extraneous free product from your order or cancel the order in its entirety. Applicable Law
By visiting the awakkeinpower.com website, you agree that the laws of the Netherlands, without regard to principles of conflict of laws, will govern these Terms of Services and any dispute of any sort that might arise between you and the Awake in Power reserve the right to modify, alter, delete and update these policies at any time we see fit. Such alterations do not nullify our rights if infringements or breaches occurred under a previous version of these conditions.
